Grant Terms and Conditions

By applying for a grant from Rainbow Wellington Inc (“RW”) you agree to the following terms:

1. Purpose of the Grant

1.1 Our shared understanding of the Purpose of a grant and the Timeframe for its use will be set out in the Grant Approval Letter. Grant funds may only be used for this Purpose.

1.2 Written consent from RW is needed for any change to this Purpose or Timeframe. RW reserves the right to decline such requests. 

1.3 Grant funds must be used in accordance with, and in furtherance of, the purposes of RW, as set out in its Constitution.

1.4 If the Purpose for which the grant was approved is no longer possible, or you are unable to use the grant funds within the Timeframe then you agree to return any unused grant funds. 

2. Payment of the Grant

2.1 The grant funds will be paid by electronic transfer to your nominated bank account once Bank Account Details are signed and returned. You may be asked to explain why the nominated bank account is not in the name of your organisation.

2.2 Alternatively, you may request RW pay a supplier’s invoice directly.

2.3 If you do not return signed Bank Account Details before the date the next Grants Round closes, RW will assume that you no longer need the grant funds, and they will be returned to the funding pool for the next round of grant applications.

3. Reporting

3.1 You agree to provide suitable confirmation to RW that the grant was used for the approved Purpose. 

3.2 You agree to provide a written report detailing how the grant was used, how it impacted your organisation, community, or project, and where possible photos and/or videos for use by RW. 

3.3 Reporting should be provided within 3 months of completing the Project.

4. Sharing of Details and Information

4.1 You agree that your contact details and other information received will be retained by RW in accordance with its Privacy Policy

4.2 You agree that such details may be shared with third parties to promote your and RW’s shared goals.

5. Publicity, Acknowledgement, and Communications

5.1 You will ensure that RW’s contribution to the Project is suitably acknowledged online and/or at the event, and in any communications, publications, or publicity concerning the Project or the grant. 

5.2 You agree that RW may use your name, image, logo, and details of the Project and any reporting (unless containing private or sensitive information) in RW’s communications, reports to members, website, and social media.

6. Intellectual Property

6.1 RW acknowledges that it is not the owner of any intellectual property created by you during any Project funded by a grant. 

6.2 You acknowledge RW’s name and logo are only to be used in accordance with these terms, and must be removed immediately from any materials, website or social media at the request of RW. 

7. Unused Funds

7.1 RW is a small charity and wishes to use all funds efficiently. As the grant is intended to support a particular Purpose, any grant funds not required for the approved Purpose must be returned to RW as soon as it becomes apparent the Project will not go ahead, or the funds will not be required, unless otherwise agreed in writing. 

7.2 If the grant is seed funding or for an initial stage of a project that has already gone ahead, then RW understands that the grant funds may have already been used. 

7.3 If your Project returns a surplus or profit, we ask you to consider how you can support our communities, including a donation to RW or another rainbow charity. 

8. Repayment of Funds

8.1 You may be required to repay all or part of the grant funds if: 

(a) The grant funds are not used for the approved purpose. 

(b) You fail to provide a report or acknowledgement as agreed. 

(c) You provide false or misleading information in your application or reporting. 

9. Discretion

9.1 All grants are awarded at the discretion of the RW Committee (or Grants Subcommittee, if delegated). 

9.2 Approval of one grant does not create any obligation or expectation on RW to fund future applications for the same or similar purposes or organisations.

9.3 Please note that the RW grants programme is administered by volunteers. While you may be upset that your application was refused or awarded less than you applied for, RW reserves the right not to engage with rude or abusive communications.

10. General

10.1 Grants are inclusive of GST (if any). You are responsible for ensuring appropriate GST treatment of the grant funds received by you. 

10.2 These terms are governed by the laws of Aotearoa New Zealand. 

10.3 Nothing in these terms creates an employment, partnership, or agency relationship between you and RW. 

Example

The Project is the overall event or programme that you are organising. The Purpose of a grant may be towards a smaller part of that.

The Project may be your group entering a float in the Pride Parade.

If the approved Purpose of the grant is specific, like “hiring a truck” then the grant funds should only be used for the cost of truck hire, not decorations and a sound system.

If you decided to hire a trailer to tow behind a car rather than a truck, then that is probably fine, but let us know, and advise any cost changes.

If the approved Purpose of the grant is more general, like “Pride Parade float” then the grant funds could be used for the cost of truck hire, decorations and a sound system, but not a party afterwards.

For either approved Purpose, if you decided not to create a float, but just march in the Pride Parade and use the grant funds for a party afterwards instead, that is not an approved Purpose, and you would need to return the funds.

Acknowledgement of the grant may be a post on your social media thanking Rainbow Wellington for their support of your Pride Parade float, a Rainbow Wellington logo on your float, and/or tagging Rainbow Wellington in your social media posts about the Pride Parade.

Reporting may consist of you providing a receipt from the truck hire company, photos of your group decorating the truck, and a video of you marching in the Pride Parade.

We may then use these photos and videos on our social media, website or Annual Report to show our members what their membership fees were used for.
